1. Agreement to Terms

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OUR SERVICES, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.

10. Dispute Resolution and Governing Law

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

10.2 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts located in Singapore to resolve any legal matter arising from these Terms or your use of the Services.

10.3 Dispute Resolution Process

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Services, you agree to first attempt to resolve the dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute through good-faith negotiations within 30 days.

10.4 Arbitration

If informal resolution is unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of the Singapore International Arbitration Centre (SIAC). The arbitration shall be conducted in English in Singapore. Each party shall bear its own costs.

10.5 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

11. Modifications to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by:

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, natural disasters, labor disputes, or government actions.

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and TriMesh Studios.

These Terms are written in English. Any translated version is provided for convenience only. In case of discrepancies, the English version prevails.
